Absztrakt
A tanulmány a reziliens építésügyi igazgatás kérdéskörével foglalkozik az állami szerepek vizsgálatán keresztül. Abból a jogdogmatikai felismerésből indul ki, hogy az építésügyi igazgatás rezilienciája az állam közhatalmi felelősségi körébe tartozik, amelynek alkotmányos alapjait az egészséges környezethez való jog, a lakhatás és az alapvető infrastruktúrákhoz való hozzáférés, valamint az élet- és vagyonbiztonság védelme adják. A tanulmány a válság fogalmát kétirányúan értelmezi: egyrészt akut, rendkívüli eseményként (természeti katasztrófák, járványok, fegyveres konfliktusok), másrészt strukturális, tartós kihívásként (klímaváltozás, energiaátmenet, urbanizáció). E kettős értelmezés indokolja, hogy az állami rezilienciakötelezettség nem szűkíthető a rendkívüli jogrendi mechanizmusokra. A tanulmány amellett érvel, hogy a ténylegesen válságálló építési igazgatás nem az állami beavatkozás mennyiségi növelését, hanem annak minőségi átalakítását feltételezi. A reziliencia nem a jogállamiság helyettesítője, hanem komplementer jogi elv: míg a jogállamiság a normativitás stabilitását és kiszámíthatóságát garantálja, a reziliencia annak dinamikus, alkalmazkodóképes dimenzióját fejezi ki - a kettő együttes érvényesülése feltétele a tartósan működőképes építésügyi igazgatásnak.
