Absztrakt

A tanulmány a bírák kirendelésének intézményét vizsgálja a bírói függetlenség szempontjából, különös tekintettel az európai összehasonlító tapasztalatokra és a magyarországi szabályozás alakulására. Három összefüggő tézis kerül megfogalmazásra. A kirendelések legitim igazságszolgáltatási érdeket szolgálhatnak, ám tömeges, kellően nem indokolt és testületi kontroll nélküli alkalmazásuk esetén sérthetik a bírói függetlenséget még akkor is, ha formálisan a bírák hozzájárulásával történnek. A karrierrendszerű bírósági modellekben a beleegyezés intézményi kontextusa nem minden esetben biztosít valódi autonómiát. Végül, a normatív keretek viszonylag csekély módosítása is érzékelhetően csökkentheti a kirendelések számát. A tanulmány összehasonlítja a német "drága kivétel" modelljét a francia nyílt fegyelmi funkcióval, majd elemzi a magyar alkotmánybírósági gyakorlatot és a 2023-as, uniós feltételességi eljárás nyomán végrehajtott jogszabályi reformokat. Az empirikus kiegészítés magyarországi bírókkal folytatott strukturált interjúkon alapul.
