Absztrakt

The relative stability of the law is an essential element of legal certainty. The expectation that the legal system will operate in a predictable and calculable manner not only stems from legal certainty but may also, in certain cases, raise the potential for a violation of fundamental rights. Protecting legitimate expectations reinforces the role of property in safeguarding personal autonomy. In this context, the essence of property protection lies in ensuring that changes in the status of individuals, based on established legal relationships that serve their existential security, are predictable and foreseeable.

The protection of legitimate expectations is a Janusfaced legal institution: its primary content was developed as a constitutional principle within the framework of legal certainty, yet certain aspects have also received fundamental rights protection. However, even in its initial stages, this protection was limited, and current practices of the Constitutional Court have further restricted its scope.
